Sealed Bids will be received by the Rivanna Water and Sewer Authority, hereinafter called the OWNER, in the Conference Room in the Administration Building at the Moores Creek Wastewater Treatment Plant, 695 Moores Creek Lane, Charlottesville, Virginia 22902 until 4:00 p.m., local prevailing time on August 11, and then at said office be publicly opened and read aloud (virtually at the sole discretion of RWSA) for the following:

The Work comprises furnishing all labor, materials, equipment, supplies and services for the replacement of the rubber dam at Sugar Hollow Dam.  Work of the project includes site erosion and sediment control; site grading for construction access; removal of existing rubber dam and underlying protection fabric; installing a new protective fabric and a new rubber dam utilizing the anchoring system in-place; replacement of electrical and mechanical components; start-up testing and training; and site restoration and permanent stabilization.  The Work shall include all work necessary to render the facilities complete and operational.

The foregoing description shall not be construed as a complete description of all work required.

The attention of all bidders is called to the provisions of the State Law governing General Contractors and Sub-Constructors as set forth under Title 54.1, Chapter 11, Code of Virginia, as amended.  Bidders shall be governed by the provisions of said law insofar as they are applicable.  The above-mentioned provisions of the Code prevent the Authority from considering a bid from anyone who is not licensed in accordance with the provisions of the Code.  The Authority will therefore, not consider any bid unless the bidder produces evidence that he is duly licensed and registered in accordance with the provisions of the Code of Virginia.

A separate performance bond and payment bond each in an amount equal to one hundred percent (100%) of the Contract price will be required.  Carriers must be authorized to do business in the Commonwealth of Virginia.

The OWNER reserves the right to reject any Proposal for failure to comply with all requirements of this Notice or of any of the Contact Documents; however, it may wave any minor defects or informalities at its discretion.  The OWNER further reserves the right to reject any and all Proposal or to Award the contract which in its judgment is in the best interest of the OWNER.

Pursuant to VA Code Section 2.2-4318, the Authority reserves the right, in the event that the bid from the lowest responsible bidder exceeds available funds, to negotiate with the lowest responsible bidder to obtain a contract price within available funds, which negotiations may include, but not be limited to, modifications to the scope of work, materials and equipment to be furnished, time for performance, price and other such terms as the Executive Director deems appropriate.

Copies of the Contract Documents may be obtained at the office of Schnabel Engineering located at 6445 Shiloh Road, Suite A, Alpharetta, GA 30005 upon payment of $500.00 for each set of documents so obtained.  Portions of the project are considered critical infrastructure and are, therefore not subject to the Freedom of Information Act (FOIA) requests.  Consequently, unsuccessful bidders are required to return all copies of the bidding documents.  Upon receipt of the returned bidding documents, the Engineer will refund $200.00 of the $500.00 fee paid by the Contractor.  All questions should be directed to Mr. JR Collins, P.E., at (770) 781-8008.

Neither the OWNER nor the ENGINEER will be responsible for full or partial sets of Contract Documents, including any Addendum, obtained from any other source.

A pre-bid conference will be held on July 8, 2020 via a web conferencing facility to review the scope of work and clarify any aspect of the work that may be in question.  The time and web conferencing sign-in information will be provided in an addendum three days before the conference. Bidders are strongly encouraged to attend and participate in the web conference.  Bidders will be allowed to visit the project site upon request. All visits shall be coordinated through the Owner’s contact: Victoria Fort at (434) 977-2970 Ext. 205 or vfort@rivanna.org. Contact at Schnabel Engineering shall be JR Collins, P.E., (770) 781-8008 for all technical questions.

Bidders must certify that they do not and will not maintain or provide for their employees any facilities that are segregated on the basis of race, color, creed or national origin, and so certify with the form included in the Proposal.  Bidders must comply with the President’s Executive Order #11246, prohibiting discrimination in employment regarding race, color, creed, sex, or national origin, and executive Order #12138 and #11625 regarding utilization of MBE/WBE firms.  Bidders must comply with the Civil Rights Act of 1964.
