Sealed Bids will be received by the Rivanna Solid Waste Authority, hereinafter called the OWNER, in the Administration Building at the Moores Creek Advanced Water Resource Recovery Facility, 695 Moores Creek Lane, Charlottesville, VA 22902 until 4:00 p.m., local prevailing time on November 7, 2017 and then at said office be publicly opened and read aloud for the IVY MUC ENCLOSED LANDFILL GAS FLARE REPLACEMENT project.  No bids will be accepted after this time.

Each Bid must be made on the blank forms provided in the CONTRACT DOCUMENTS and must be enclosed in a sealed envelope and the envelope marked: “Ivy MUC Enclosed Landfill Gas Flare Replacement, RFB No. 340”.   Each Bid must be accompanied by a Bid Security which shall not be less than five (5%) percent of the Bid amount.  No bidder may withdraw his Bid within 60 days after the date of Bid opening.

The attention of all bidders is called to the provisions of the State Law governing General Contractors and Sub-Contractors as set forth under Title 54.1, Chapter 11, Code of Virginia, as amended.  Bidders shall be governed by the provisions of said law insofar as they are applicable. The above-mentioned provisions of the Code prevent the Authority from considering a bid from anyone who is not licensed in accordance with the provisions of the Code.  The Authority will therefore, not consider any bid unless the bidder produces evidence that he is duly licensed and registered in accordance with the provisions of the Code of Virginia.

A separate performance bond and payment bond each in an amount equal to one hundred percent (100%) of the Contract price will be required.  Carriers must be authorized to do business in the Commonwealth of Virginia.

The Owner reserves the right to reject any Proposal for failure to comply with all requirements of this Invitation or of any of the Contract Documents; however, it may waive any minor defects or informalities at its discretion.  The Owner further reserves the right to reject any and all Bids or to Award the contract which in its judgment is in the best interest of the Owner.

Pursuant to VA Code Section 2.2-4318, the Authority reserves the right, in the event that the bid from the lowest responsible bidder exceeds available funds, to negotiate with the lowest responsible bidder to obtain a contract price within available funds, which negotiations may include, but not be limited to, modifications to the scope of work, materials and equipment to be furnished, time for performance, price and other such terms as the Executive Director deems appropriate.

Pursuant to VA Code Section 2.2-4324, Bid results shall be subject to the Preference for Virginia Firms stipulation.

COPIES OF CONTRACT DOCUMENTS WILL NOT BE AVAILABLE UNTIL OCTOBER 23, 2017.

Neither the Owner nor the Engineer will be responsible for full or partial sets of Contract Documents, including any Addendum, obtained from any other source.

Bidders must certify that they do not and will not maintain or provide for their employees any facilities that are segregated on the basis of race, color, creed or national origin, and so certify with the form included in the Proposal.  Bidders must comply with the President’s Executive Order #11246, prohibiting discrimination in employment regarding race, color, creed, sex, or national origin, and Executive Order #12138 and #11625 regarding utilization of MBE/WBE firms.  Bidders must comply with the Civil Rights Act of 1964.

The Authority reserves the right to disapprove any subcontractor, supplier, vendor, surety or insurer proposed by a bidder for this Project for good cause shown.
